A vueltas con la obediencia debida:: ¿mandatos antijurídicos obligatorios?

    Que no caben mandatos de contenido antijurídico obligatorios en nuestro Derecho resulta fácilmente visible. En el terreno de las antinomías jurídicas, las reglas de la teoría general del Derecho dan mayor peso al deber general de no cometer ilícitos en detrimetro del delito de desobediencia tipificado en el artículo 410 del Código Penal, del que parece inferirse que el subordinado está en ciertos casos obligado a cometer delitos. La Antinomia se resulve mediante el principio de jeraquía normativa que hace prevalecer el artículo 20.7 del Código Penal puesto en relación con los artículos 9.1 y 103.1 de la Constitución Española. Y a igual solución se llega desde el terreno de os intereses tutelados por el Derecho pues a la Administración no se le encomiendan fines o misiones al margen del Derecho.

    The fact thar there ins't any room for compelling unlawful orders in our law, is readily seen. In the legal antinomíes arena, the rules of law common theory give more considerations to the legal duty to not commit crimes to the detriment of the duty to obey orders whose violation is punished by the article 410 of the Criminal Code from which seems infer that the subordinate is to commit crimes in some cases. The antinomy must be resolved by menas of the normative hierarchy principle which makes prevail the article 20.7 or the Criminal Code in relation with articles 9.1 and 103.1 of the Sapnish Constitution. The same outcome turns out from the framework of the interests promoted by the law because the Administration in not entruted by goals or missions outside the law.
