Risk is the contingency of a damage. Contingent is something that could be or not could be. Contingency is opposed to impossibility and necessity, because contingent is something that is neither impossible nor necessary. That is the reason because risk antonyms's are security and certainty. These binomials contingency/necessity and risk/security are those who would be choose by any specialized jurist to begin to talk about the risk law in contemporary societies. Nevertheless, in this work, we don't go in this direction and we take another way more risky. We will go into the concept of risk from the difference risk/danger and to the demonstrate how this view can change the theory of legal systems
