La justicia restaurativa es una nueva manera de considerar a la justicia penal, la cual se concentra en reparar el daño causado a las personas y a las relaciones más que en castigar a los delincuentes. La justicia restaurativa es una justicia de consenso, de participación en la solución del conflicto originado con el delito por todos sus afectados.
El nuevo Código de Procedimiento Penal, en nuestra legislación, incluyó esta forma de justicia en tres mecanismos:
conciliación preprocesal, conciliación en el incidente de reparación integral y la mediación para los delitos investigables de oficio. Para saber de la aplicación y desarrollo de esta institución procesal, resulta fundamental conocer la forma en que se encuentra regulada en otros países, esto es, acudir al derecho comparado, y es precisamente lo que planteados en el presente acápite.

The restorative justice is a new way of considering to the penal justice which centers in repairing the hurt caused to the persons and to the relations more than in punishing the delinquents. The restorative justice is a justice of consensus, of participation in the solution of the conflict originated with the crime for all his affected ones. The new code of penal procedure, in our legislation, include this form of justice in three mechanisms: conciliation preprocesal, conciliation in the incident of integral repair and the mediation for the crimes investigables of trade.
To know about the application and development of this procedural institution, it turns out to be fundamental to know since it is regulated in other countries, this is, to come to the compared right, and is precisely what raised in the present clause.
