La globalización del derecho y la formulación de la política ambiental en Colombia

    Este artículo presenta los principales avances del proyecto de investigación �Globalización y Política Ambiental en Colombia�; en el cual se aborda el tema de la globalización de los campos jurídicos a partir de una de las formas de transnacionalización del derecho propuestas por Boaventura de Sousa Santos, como lo es el Ius Humanitatis y la influencia que éste ha tenido en la formulación de la política ambiental en Colombia. Para este fin se identifica en primer lugar el enfoque teórico y discursivo de la investigación a partir de los planteamientos esbozados por Sousa Santos; en segundo lugar, se describe el desarrollo de la globalización del derecho y el Ius Humanitatis; y en tercer lugar, se identifican los principales instrumentos internacionales que influencian la política ambiental doméstica y se analizan los principios que han permeado el tema en los últimos años en nuestro país.

    This article shows the advances reached in the research Project titled �Globalization and Environmental Policy in Colombia�, a project that tackles the topic of globalization by means of a Law transnationalization element such as the Ius Humanitatis and its influence in the formulation of the environmental policy in Colombia. The general objective of this research project is to describe and analyze the influence that Law globalization has had in the formulation of environmental policies in Colombia, by means of the Ius Humanitatis postulates. Firstly, and to achieve this goal, the research theoretical and discursive approaches are identified following Boaventura de Sousa Santos� statements. Secondly, the development of Law globalization and the Ius Humanitatis is described; and finally the main international instruments for domestic environmental policies are identified, together with an analysis of the principles that have influenced this matter during the last years in our country.
