Cuatro indicios de la influencia de la Declaración Universal de los Derechos Humanos de 1948 en el constitucionalismo colombiano

      El autor desarrolla la tesis de la influencia de la Declaración Universal de los Derechos Humanos de 1948 en el constitucionalismo colombiano a partir de la identificación de cuatro indicios: 1. el conocimiento y la invocación de la Declaración Universal por parte de varios delegatarios a la Asamblea Constituyente de 1991; 2. algunas cifras sobre la invocación de la Declaración Universal durante los primeros 16 años de funcionamiento de la Corte Constitucional colombiana; 3. algunos datos cualitativos sobre la influencia de la Declaración Universal en la concepción de los derechos fundamentales de la Corte Constitucional colombiana; y, finalmente, 4. una breve reseña de algunos manuales de derecho constitucional, donde se indica la forma en que estos han o no acogido los contenidos de la Declaración, así como la relación de esta última con el derecho interno.

      The author proposes a thesis about the influence of the Universal Declaration of Human Rights over the Colombian constitutionalism. He presents the existence of at least four set of facts to prove it. The said facts are as follows.

      Firstly, the fact that on 1991, the Constitution makers knew the importance of the Universal Declaration, and used it to frame the Constitution´s bill of rights. Secondly, some statistics regarding the times in which the Declaration has been used by the Colombian Constitutional Court to decide cases, since 1992 until now days. Thirdly, a qualitative approach about the said uses of the Universal Declaration by the Colombian Constitutional Court, specially, the way that the Declaration has been used to perform an innovative concept of fundamental rights. And finally, the description of some constitutional law handbooks, regarding the way in which the authors of these books have dealt with the Universal Declaration and have explained the relationship between the said Declaration and the Colombian domestic law.
