El artículo tiene como objeto examinar cuál ha sido la influencia de la ciencia penal italiana en Chile. Si bien es cierto, nuestra doctrina penal se encuentra hoy dominada por las ideas provenientes de Alemania, ello sólo comenzó a apreciarse de manera nítida a partir de la década del cincuenta del siglo pasado. Y es que hasta ese entonces, la ciencia predominante era la italiana, cuyos planteamientos llegaron a Chile mucho antes de lo que usualmente se sostiene. Ya nuestras primeras publicaciones jurídicas daban cuenta de los debates que tenían lugar entre los positivistas italianos. Asimismo, se analizan las razones que llevaron a la ciencia italiana a perder su hegemonía, cediendo frente a la alemana. Por otro lado, el artículo expone el aporte de la actual ciencia penal italiana y por qué debiera prestarse mayor atención a sus trabajos.

The objective of the article is to examine the influence of Italian Penal Science in Chile.
Although our penal doctrine is presently dominated by ideology originating from Germany, this was only fully appreciated during the 1950s. Before then, the predominating science was Italian, whose approaches arrived to Chile much earlier than what is currently maintained. Our first judicial articles realized that the debates that had weight belonged to the Italian Positivist approach. The reasons of what lead the loss of hegemony of the Italian Penal Science Approaches and its eventual yielding to the German Penal Science approaches are analyzed. On the other hand, the article presents the contribution of present Italian Penal Science and gives reasons as to why more attention should be paid to its work.
