    Numerosos autores de la tradición liberal que se ha ocupado de los derechos humanos parecen concebir la posibilidad de fundamentar éstos al margen de consideraciones metafísicas. El autor del trabajo se plantea si puede haber derechos humanos libres de metafísica, y, en caso de que tal cosa no fuera posible, si los derechos humanos afectados por la metafísica son necesariamente una ilusión. Para responder a estos interrogantes el autor analiza, en primer término, el concepto de derechos humanos, mostrando que su existencia radica en su fundamentabilidad. Esta reflexión le lleva a abordar, en segundo término, el problema de la justificación de los derechos humanos. Finalmente el autor aborda la cuestión de si la fundamentación de los derechos humanos contiene o presupone elementos metafísicos

    Authors within the liberal tradition have defended the possibility to give human rights a foundation far from the realm of metaphysics. Following this line of thought, Alexy, in his article, considers whether there are human rights free of any metaphysical assumptions. And, were that not the case, whether human rights affected by metaphysical considerations are necessarily mere illusions. In order to answer these questions, the author, in first place approaches the concept of human rights underlying the idea that their existence is exhausted in the possibility of their foundation. In second place and consequently, he explores the problem of human rights justification. Thirdly the author considers whether the foundation of human rights contains or presupposes metaphysical ingredients.
