    La Ley consagra el deber ser, los propósitos, derechos y procedimientos para proteger la vida y el ambiente, pero las prácticas sociales en su conjunto contradicen la normativa, lo cual dificulta la protección. El fracaso no es exclusivo de la legislación colombiana sino también de acuerdos y declaraciones internacionales, constituidos en simples enunciados normativos para cuya ejecución no existe voluntad política. El fracaso político de las leyes de protección al ambiente y los derechos que de éste se desprenden se debe no sólo a las "debilidades en los mecanismos de aplicación o insuficiente reglamentación", sino, además, al equivocado "énfasis del Derecho Ambiental en los síntomas y no en las causas fundamentales de la contaminación".

    The Law consecrates the duty to be, purpose, rights and procedures to protect the life and the atmosphere, the social practices in its group contradict the normative one, making difficult and distant the protection. The failure is not exclusive of the Colombian legislation, also of Agreements and International Declarations. Enunciated normative that stops whose execution the political will doesn't exist, that is to say, mere "catalogs of illusions". far from contributing to the global uneasiness, but it burdens, these legislative efforts conclude as records of the failure, of the law to protect the atmosphere and their rights, in the one which this committed one so much the law and its rationality like the whole occident pattern, not correspond alone to those "Weaknesses in the application mechanisms or insufficient regulatio", or to the mistaken one "Emphasis of the environmental right in the symptoms and not in the fundamental causes of the contaminatio".
