    La Convención de Viena sobre compraventa internacional regula el instituto del riesgo, vinculando su transmisión al comprador con sucesos comerciales relevantes en los tipos contractuales más frecuentes en el tráfico. En la Convención, la pérdida o deterioro accidental de las mercaderías, posterior a la transmisión del riesgo al comprador, no le libera de su obligación de pagar el precio, ni menos aún le autoriza para invocar dicha pérdida, o deterioro, como incumplimiento contractual, salvo que él mismo pruebe que su causa fue la conducta del vendedor. Mientras el riesgo no se transmita al comprador, el vendedor debe soportar la pérdida o deterioro que experimenten las mercaderías, debiendo, igualmente, cumplir su obligación de entrega; si no lo hace, hay incumplimiento contractual, con las consecuencias jurídicas que éste produce.

    The Vienna Convention about international contract of purchase and sale governs the risk institute, linking its communication to the buyer with relevant commercial events in the most frequent contract types in traffic. In the convention, the loss or accidental damage of the merchandise, after the risk is informed to the buyer, does not free the buyer from his obligation to pay the price nor does it authorize him to proclaim such loss or damage to contract unfulfillment unless he can prove that the behavior of the seller caused it. While the risk is not communicated to the buyer, the seller must respond for the loss or damage that the merchandise suffers and at the same time must fulfill his obligation of delivery; if he does not do this, there is contract unfulfillment with the legal consequences this brings.
