La reforma del Estado de las Autonomías: ¿ruptura o consolidación del modelo constitucional de 1978?

    En el número 2 de la REAF, el professor Pedro Cruz plantejava l'aprovació de l'aleshores Projecte d'Estatut d'autonomia de Catalunya com a moment inicial d'una transformació en la concepció constitucional de l'Estat autonòmic, fet que el duia a afirmar que l'actual estructura territorial de l'Estat estaria en vies de ser substituïda, més o menys nítidament, per una altra. No estaríem, doncs, davant d'un simple reajustament de l'Estat de les autonomies, sinó davant d'un "altre Estat de les autonomies". En aquest article, això no obstant, es defensa que el que es produeix en l'actualitat és simplement el desplegament del nostre model vigent des dels seus mateixos pressupòsits constitucionals, bo i potenciant-ne els aspectes fins ara més febles, i que, per tant, estem no davant d'una substitució del sistema sinó davant del seu desplegament adequat i natural. Així, el "segon Estat de les autonomies" de què parlava Cruz es concep aquí com una nova etapa del mateix Estat de les autonomies en la qual es concreten aspectes com ara la distribució competencial o el finançament, i es dóna sortida a les noves necessitats de participació de les institucions autonòmiques en les decisions de l'Estat; tot això amb la finalitat de poder construir formes més intenses d'integració política dels ciutadans, en la mateixa comunitat autònoma i en el model constitucional espanyol.

    In an article which appeared in the second issue of REAF, Professor Cruz suggested that the proposal adopted by the Catalan Parliament to reform the Statute of Autonomy of Catalonia would led to a substantial transformation of the territorial structure of Spain. Indeed, he argued that such a transformation would go beyond the structures and aims set out in Spanish Constitution. In this sense, Professor Cruz believes that the implementation of the new Statute of Autonomy would result in the establishment of territorial structure of powers completely different from the model envisaged from the Constitution. In the present article, Professor Roig argues against Prof. Cruz's thesis, asserting that the institutional setting which would result from the implementation of the new Statute of Autonomy of Catalonia falls squarely within the framework established by the Spanish Constitution. He argues that this new institutional setting should be considered a step forward in the development of the original territorial model of Spain: a model which aims at providing a clearer definition of matters such as the distribution of powers and the financing system; and at finding responses to new institutional needs such as the participation of the Autonomous Communities within the decisionmaking processes relating to state-wide issues
