La sentencia nº 228/2014, de 10 de septiembre, de la Audiencia Provincial de A Coruña (Sección 6ª) desestima el recurso interpuesto contra la sentencia de 12 de abril de 2013, del Juzgado de Primera Instancia e Instrucción nº 1 de Padrón. La sentencia de instancia condenaba al titular de un coto de caza a indemnizar a un conductor por los daños ocasionados en el vehículo al producirse un accidente de tráfico ocasionado por un jabalí, procedente de un coto de caza, que invadió la carretera y fue atropellado por el vehículo. La sentencia de apelación, por tanto, ratifica la interpretación del juzgador de instancia y confirma la responsabilidad del titular del coto de caza por ser el accidente consecuencia directa de la acción de cazar. |
| Resum: |
The sentence No. 228/2014, on 10th September, of the Provincial Court of A Coruña (Section 6) rejects the appeal interposed against the sentence of the Court of First Instance and Instruction No. 1 of Padron, on 12th April 2013. The first sentence condemned the owner of a hunting preserve to indemnify a driver and its insurance company because of the damages caused by a wild boar, coming from a hunting preserve, which stormed the road and was knocked down by the vehicle. The second sentence, therefore, ratifies the interpretation of the first judge and supports the responsibility of the hunting preserve's owner, considering the accident as a direct consequence of the hunting action. |
