Fundamental Rights consist of a system of values in order to guarantee the survival of the community. However, the most significant evolution of the Fundamental Rights theory begins with the acknowledgement, together with the concrete individual guarantee, of a legal-objective dimension. This new approach has been essential for reinforcing Fundamental rights, in which respect for the social state there appears to be not only the prohibition of excess as well as that of omission. The Spanish Constitutional Tribunal acknowledges under the 25/1981 sentence the double character of Fundamental Rights, that is, its consideration as far as subjective public rights, and as essential elements for the objective order of the community, due to its immediate regulatory efficiency, its validity and guaranty affects essentially the legitimacy of the State; this explains that the main part of the same receives privileged jurisdictional protection from the Constitutional Tribunal. The imposition of the Fundamental Rights in Spain was unlikely without the guarantee of a Constitutional Tribunal being committed to the new Constitution.
