En el marco de la discusión de la reforma procesal civil que en Chile se está realizando, el presente artículo propone llevar a cabo la necesaria modificación del arbitraje doméstico, extrayendo la regulación de este instituto de los Códigos procesales que hoy la contienen, para llevarla a una legislación independiente que muestre mayor coherencia con los modernos principios arbitrales, actualmente recogidos sólo en la legislación comercial internacional (LACI).

In the frame of the discussion of the procedural civil reform that in Chile is realized, the present article proposes to carry out the modification of the arbitration in domestic Law, extracting the regulation of this institute of the procedural Codes that today contain it, to take her to an independent legislation that shows major coherence with the modern arbitral beginning, nowadays gathered only in the commercial international legislation (LACI).
