    Se analiza el desarrollo de los derechos humanos como producto del devenir histórico, reconocidos paulatinamente por el Estado en coherencia con el progreso de la sociedad y sus diversas reivindicaciones de protección social. De acuerdo con la clasificación de Karen Vasak, se propone una cuarta generación de derechos humanos que considere la protección al usuario de servicios de salud como uno de sus elementos centrales. Finalmente, se puntualiza el papel de la protección social en el Sistema de Salud de México y la atribución legal conferida a la Comisión Nacional de Arbitraje Médico en el terrero de protección al usuario de servicios de salud.

    The evolution of the human rights is analyzed as product of to historical development, recognized gradually for the State into coherence with the progress of the society and their diverse recoveries of social protection. In agreement with Karen Vasak�s classification, a fourth generation of human rights proposes to consider the protection to the user of health services as one of his central elements. Finally, there is specified the role of the social protection in the Health System of Mexico and the legal attribution awarded to the National Commission of Medical Arbitration in the protection area to the user of health services.
