El nuevo artículo 174.2 de la Ley General de la Seguridad Social y su incidencia en la pensión compensatoria en los supuestos de separación y divorcio

    La nueva reforma del artículo 174.2 de la LGSS mediante Ley 26/2009, de 23 de diciembre sobre presupuestos generales del 2010, realiza reformas de gran importancia en el artículo 174.2 de la LGSS y además contempla una norma transitoria sobre pensión de viudedad en supuestos de separación judicial o divorcio anteriores al 1 de enero de 2008 que se recoge en la Disposición Transitoria decimoctava que se introduce en el texto refundido mediante la Ley General de Seguridad Social. En el presente estudio se analiza la reforma así como los problemas que plantea pero limitada exclusivamente a los supuestos de separación judicial o divorcio.

    The new reform of article 174.2 of General Law of Social Security 26/2009, of 23th December 2010 about the general budget for 2010, makes great reforms in the article 174.2 of the LGSS and moreover has a transitory norm about widow’s pensions in the situations of judicial separation or divorce before the first of Januar of 2008 which are in the transitory norm number 18, which it is introduced in the refunded text of the General Law of Social Security. In the present article it is analysed the reform as well as the problems in its application, but limited exclusively to the situations of judicial separation or divorce
